CAB2GO TERMS AND CONDITIONS

The website www.cab2go.com, the CAB2GO text message booking service, the CAB2GO email booking service, the CAB2GO phone booking service and all related software (“CAB2GO Service”) are provided by CAB2GO Limited, company registration number 04592236, at registered address AML Maybrook House, 97 Godstone Road, Caterham, Surrey CR3 6RE (“CAB2GO”).

The CAB2GO Service is governed by these Terms and Conditions. We reserve the right to change these Terms and Conditions from time to time when it is reasonable or necessary for us to do so. Any such changes will be incorporated in an updated version of these Terms and Conditions and posted on www.cab2go.com and shall be effective from the time of posting on the website. 

By using the CAB2GO Service, you agree to be bound by these Terms and Conditions. Please ensure that you read and understand these Terms and Conditions before using the CAB2GO Service.

CAB2GO as Agent

When you order a mini-cab through the CAB2GO Service, CAB2GO operates as an agent between you and mini-cab operators. When you accept carriage by a mini-cab operator through CAB2GO, you will be entering into a contract for a mini-cab service directly with the mini-cab operator and separately from the CAB2GO Service, subject to the mini-cab operator’s terms and conditions. CAB2GO is not a party to that mini-cab contract and CAB2GO, to the extent permitted by law, assumes no liability in respect of that mini-cab contract. The mini-cab operator’s terms and conditions can be obtained from the mini-cab operator directly.

All of the mini-cab operators who operate through CAB2GO are licensed with the Public Carriage Office (“PCO”). The PCO administers a licensing regime to ensure that mini-cab operators comply with certain legal requirements.

Using the CAB2GO Service

When you access, contact or use the CAB2GO Service, you agree that you will not:

·         use the CAB2GO Service in an unreasonable, unauthorised and/or unlawful manner;

·         modify, copy, display or distribute the CAB2GO Service (or any part of it) unless expressly permitted by CAB2GO;

·         reverse engineer, decompile (whether whole or in part) any software used in the CAB2GO Service (except to the extend expressly permitted by law)

·         use the CAB2GO Service for any commercial purpose without the prior written consent of CAB2GO;

·         include or create links (including deep-links) to or from the CAB2GO website;

·         hack into, transmit any computer virus to, or otherwise interfere with, the CAB2GO Service which in any way affects the operation and/or performance of the CAB2GO Service and/or inhibits other users from using the CAB2GO Service.

Any and all copyright, trade mark, patent or any other intellectual property in any material or content included in the CAB2GO Service (“Content”) is owned by CAB2GO or its licensors. You can only use Content in accordance with these Terms and Conditions. We grant you a non-exclusive, non-transferable right to use the Content for your own private non-commercial use on your own PC, mobile phone or other suitable personal device.

You should inform us as soon as possible if you become aware of any unauthorised use or copying of Content or any unauthorised or inappropriate use of the CAB2GO Service.

Changes to the CAB2GO Service

We reserve the right to change or discontinue any part of the CAB2GO Service at any time. We will endeavour to give as much notice of such change or discontinuation as possible and will provide such notice on www.cab2go.com and when you use the CAB2GO Service.

Ordering a Mini-Cab

You can currently order a mini-cab through CAB2GO by text message, by email or by phone. To order a mini-cab, you need to provide us with your PICKUP LOCATION, your DESTINATION and your NAME. We will then provide you with a list of up to 3 mini-cab operators to choose from. Each mini-cab operator supplies a quote for the journey and an estimated time of arrival of a mini-cab.

Once you notify us of which mini-cab you want, we will give you contact details of the mini-cab operator and the mini-cab will be dispatched to your pickup location. If you need to query, change or cancel your journey from this point on, you will need to contact the mini-cab operator directly.

If you are ordering a mini-cab by text message, you can cancel the order at any time before you select a mini-cab by either sending a text message including the words “cancel” or by simply not selecting a mini-cab.

CAB2GO cannot guarantee that a mini-cab will be able to attend to your order. You will be notified of this accordingly.

We require that you use the CAB2GO Service in a responsible manner and only make genuine orders. We reserve the right to decline your order if we determine that your order is not genuine or if you have previously used the CAB2GO Service in breach of these Terms and Conditions or you have previously breached the terms and conditions of a mini-cab operator used through CAB2GO.

Cost of Service

Using the CAB2GO Service by text messaging is subject to standard rates for sending text messages as determined and charged by your mobile phone operator. To order a mini-cab, you will need to send at least 2 text messages.

Standard rates for 0870 phone calls apply for calls to the CAB2GO phone booking service.

CAB2GO does not charge a booking fee to use the CAB2GO Service.

Disclaimer

The CAB2GO Service is provided on an “as is” basis and CAB2GO makes no warranty, express or implied, with respect to the CAB2GO Service and/or the Content including without limitation satisfactory quality, fitness for a particular purpose, reliability, timeliness, accuracy or the CAB2GO Service being error free unless specifically set out in these Terms and Conditions.

You acknowledge that the CAB2GO Service may, from time to time, be affected by events outside the control of CAB2GO, including, but not limited to, delay or failed delivery of SMS text messages due to network congestion or failure. In no event shall CAB2GO be liable for any losses, costs, expenses or liabilities incurred as a result of any such events.

To the extend permitted by law, CAB2GO shall not be liable for any losses, costs, expenses or liabilities incurred as a result of any error, defect, interruption, delay or performance failure of the CAB2GO Service.

CAB2GO shall not be liable for any indirect, special or consequential damages or losses including, without limitation, damages for loss of use, loss of profits, loss of data or the cost of procurement of substitute goods or services whether such damages or losses arise in contract, negligence, tort or otherwise.

Any links on the CAB2GO website to any third party sites are provided for your convenience only and CAB2GO shall not be responsible for the content of those third party websites nor does CAB2GO endorse those third party websites. Any complaint with such websites must be addressed with the website owner directly.

Nothing in these Terms and Conditions shall limit CAB2GO’s liability in respect of personal injury, death or fraud.

Miscellaneous

Law and Jurisdiction. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales and you hereby submit to the exclusive jurisdiction of the English Courts.

Rights of Third Parties. A person who is not a party to these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any of these Terms and Conditions.

Severability. If any part of these Terms and Conditions shall be deemed to be legally invalid or unenforceable then the invalid or unenforceable provision shall be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms and Conditions shall remain in full force and effect.
